What information may be used?

  • your name, job title, employer or business;
  • business contact details such as a work email address;
  • publicly available professional or business information relevant to a potential engagement;
  • information you provide in enquiries or correspondence;
  • records of communications, objections and opt-out/suppression preferences; and
  • basic technical connection information processed by hosting infrastructure to deliver and secure this website.

Where does the information come from?

Information may come directly from you, or from public business and professional sources such as company websites, public directories, public professional profiles, marketplaces, published material and other sources that are reasonably relevant to the business purpose.

Why is it used?

  • respond to enquiries and discuss potential work;
  • identify businesses or business contacts for highly targeted, one-to-one B2B outreach;
  • understand whether SwayBorne's services are plausibly relevant to a specific business decision;
  • manage commercial communications and follow-up; and
  • maintain suppression records so opt-outs and objections are respected.

Lawful basis and electronic marketing

Where personal data is used for proportionate B2B prospecting or business development, I may rely on legitimate interests where that basis is appropriate after considering the purpose, necessity and impact on the individual.

Electronic-marketing rules can differ by recipient type. Corporate subscribers such as limited companies and LLPs are treated differently under PECR from sole traders and certain partnerships. Where PECR requires consent, legitimate interests are not used as a substitute for that consent.

You can object to direct marketing at any time. If you do, I will stop using your personal data for that purpose and may keep a minimal suppression record so that your preference continues to be respected.

Who may receive the information?

Information is not sold. It may be processed by service providers used to operate SwayBorne, including email, domain/DNS, website-hosting, security and other necessary business infrastructure. Current infrastructure includes Spaceship/Spacemail for domain and email services and Netlify for website hosting.

International processing

Some service providers may process information outside the United Kingdom. Where this occurs, I use providers on the basis of the transfer arrangements and safeguards that apply to their services and the relevant processing.

How long is information kept?

Information is kept only for as long as reasonably necessary for the purpose for which it was collected, and is reviewed when it is no longer relevant. Suppression information may be retained for as long as needed to make sure a marketing objection or opt-out is respected.

Your rights

Depending on the circumstances, UK data-protection law may give you rights to request access, correction, erasure or restriction of your personal data, and to object to certain processing. The right to object to processing for direct marketing is absolute.

To exercise a right, email privacy@swayborne.com. You can also complain to the UK Information Commissioner's Office (ICO) if you are unhappy with how your personal information has been handled.

Website cookies and analytics

This website does not intentionally set analytics, advertising or tracking cookies, and it does not contain contact forms or tracking pixels. The hosting provider may still process ordinary network and security information required to deliver and protect the site.
